Probate

Probate is one of the strongest areas in the Law Offices  of Craig Seldin. From  drafting wills to probate litigation, he can help any client.  Mr. Seldin takes time to interview each client to find the needs of each estate. There are various options that can take place.  Mr. Seldin is very skilled in this area and will help guide you down the right path to making sure your last wishes are granted. After all the information is gathered, Mr. Seldin will draft the client’s will with as much detail as the client dictates.

Mr. Seldin handles heirship cases where there is no will, as well as probating wills.  Since many probates are uncontested, they can be accomplished in just a few months.  Cases are set on the docket after the probate follows the statutory guidelines of the Texas Probate Code.  The client and Mr. Seldin will then appear in a prove-up hearing with the client to satisfy the prerequisites for judicial approval.

Probate litigation can occur when there is ambiguity in the language of a will, of if one or more parties allege that some improper influence or pressure was applied to the testator.

Where no will exist or can be located, this is called an intestate matter.  These are the types of matters in which heirship must be determined.  The client can accompany an application for declaration of heirship with an application for being named as an administrator of the estate.   If the law can determine the heirs and they can all agree on a disposition of the estate under Texas Law, the cases will be easier to resolve.  If this does not prove to be true, then Mr. Seldin will represent the client in trial.
